As of July 1, 2026, only 21 states which permitted state-regulated gambling have 100% smokefree gambling facilities laws, leaving people in some Midwestern and Southern states without full protection from secondhand smoke in gambling facilities.

Footnote

Gambling facilities includes only state-regulated, non-tribal gambling facilities. Tribal gambling facilities are sovereign and not covered by state laws. States marked as having smokefree gambling facilities include at least one of the following types of gambling: non-tribal casinos and racinos, card clubs, race tracks, and/or jai-alai centers.
